Masher Media Inc. is committed to protecting and safeguarding consumer privacy on the Internet, especially for children. We are providing this privacy policy ("Privacy Policy") to help assure a rewarding experience for our visitors. This Privacy Policy describes the information practices of our web site -www.MyMiniPeeps.com- including how we collect, use and disclose the personal information provided to us on the MyMiniPeeps website and collected through the in-game play of the MyMiniPeeps environment (collectively the "Site). We may at our sole discretion edit this Privacy Policy from time to time. Notice of all changes to the Privacy Policy will be provided as specified in Section 2 (MODIFICATION AND NOTIFICATION OF CHANGES) of the Terms of Use. We encourage parents or guardians to regularly monitor and supervise their children's on-line activities.

 

1. The Information Masher Media Collects From You

We directly collect from child users during our initial registration process a parent's or guardian's email address, the child's desired account name, gender, child's date of birth, child's State, Country and the child's password. The Site requires child users to provide a parent's or guardian's valid email address in order to register. We use this information to:

  • Send the parent or guardian a message that can be used to activate the MyMiniPeeps account,
  • Notify the parent or guardian about our privacy practices,
  • Send the parent or guardian communications either about the parent's or guardian's and child's MyMiniPeeps accounts or about features of the Site, and
  • For the other purposes described in this Privacy Policy.
This parent or guardian email address is correlated with the child's account user name.

 

Once we have received approval from the parent or guardian to activate the child's account, we may collect additional personally identifiable information ("PII") from the registrant's parent or guardian, for example, when a MyMiniPeeps child registrant acquires a paid membership the types of PII that may be collected include the parent's or guardian's full name, email address, and credit card billing information including mailing address. The Site does not condition a child's participation in an online activity on the child's providing more personal information than is reasonably necessary for that activity.

 

We may also request a user name or e-mail address when a user submits a form through the "Contact Us" portion of the Site so that we may respond to the inquiry. We collect the user name or e-mail address for the sole purpose of responding directly on a one-time basis to a specific inquiry.

 

For some of our online activities-such as polls or surveys-we may ask users to provide information that is not personally identifiable, such as country of residence or favorite color.

 

We also enable users to chat online through our website, but we take measures to minimize users' ability to communicate personal information through this chat function. These measures include filters and live moderation. Nonetheless, if you use the chat function within the Site and disclose personally identifiable information, you should be aware that such information could be read, collected or used by other users. We are not responsible for the personally identifiable information you choose to expose through the chat function. Finally, we may offer blogs or other Public Forums, as well as other features where you may provide us with Submissions, but we take measures, including live moderation, to minimize users' ability to communicate personal information through these Public Forums. If you use a Public Forum on the Site, and disclose personally identifiable information, you should be aware that such information could be read, collected or used by other users. We are not responsible for the personally identifiable information you choose to expose in these Public Forums.

 

Additionally, when visitors come to the Site, we may passively collect certain non-personally identifiable computer information, such as the type of computer operating system (e.g., Windows or Mac OS), the web browser (e.g., Safari, Internet Explorer) being used, the frequency with which guests visit various parts of our sites, and information regarding the Internet service provider, in order to make the Site more interesting and useful to you and for various purposes related to our business. We may collect this non-personally identifiable information through the use of software technologies such as unique identifiers or "cookies." Cookies are small text files that we place in visitors' computer browsers to store their preferences. Cookies are widely used, and most web browsers are configured initially to accept cookies automatically. Regardless of whether you are a registered user of the Web Site, the Site attempts to install cookies when a user arrives at our Site. Some of these cookies are a type called "persistent cookies," that remain in your computer's memory and identify you whenever you visit our Site. These cookies are necessary for the Site to "remember" selections you have made and to present you with the same view of the Site from visit to visit. You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser (like Safari or Internet Explorer) settings. Each browser is a little different, so look at your browser Help menu to learn the correct way to modify your cookies settings. If you turn cookies off, you won't have access to many features that make your Web experience smoother, and some of our services may not function properly (for example, the Site won't "remember" certain settings from visit to visit).

 

Finally, we collect financial information from parents as set out in Section 6 of this Privacy Policy. We do not use this financial information for any purpose other than processing payments to MyMiniPeeps. The financial information that you enter to purchase a membership is not stored by MyMiniPeeps, but, instead, is retained by our payments processing vendor for the purpose of processing credit card payments made to MyMiniPeeps. If certain personal information is not provided to us, then you may not be able to access to certain content and functionality on the Site, or to provide other information, products or services which may be requested.

 

2. How We Use, Disclose, and Store the Information We Collect

In addition to the purposes described in Section 1, we may actively collect and use email addresses and user names to track usage and to monitor whether users are complying with the Site's TOU. In addition, we may use an email address and user name to ban a user temporarily or permanently from the Site if that user engages in inappropriate conduct on the Site. We may also use email addresses and user names to enable parents or guardians to review PII that the children have submitted to the Site and to provide notification regarding the Site, such as any future amendments to the TOU or this Privacy Policy. We also may use aggregated, anonymized information to analyze site usage, as well as to offer products, programs, or services.

 

We may disclose information where we are required to do so by law, for example, in response to a court order or a subpoena, or where we disclose information to service providers or other group companies who provide support for the operations of our Site and who are contractually obligated not to use and not to disclose the information for any other purpose. To the extent permitted by applicable law, we also may disclose PII in response to a law enforcement agency's request or if we feel that such disclosure may prevent the instigation of a crime, facilitate an investigation related to public safety or protect the safety of a child using our website, protect the security or integrity of our website, or enable us to take precautions against liability.

 

If we sell all or part of our business or make a sale or transfer of our assets or are otherwise involved in a merger or business transfer, we may transfer PII to a third party as part of that transaction, to the extent permitted by applicable law.

 

3. Consent To Processing In The United States

By providing any PII to the Site, all users, including, without limitation, users in Canada and the member states of the European Union, fully understand and unambiguously consent to this Privacy Policy and to the transfer of such Personal Information across international borders in accordance with MyMiniPeeps' standard operations, including the collection, storage, and processing of such information in the United States of America. Collection, storage and processing of personal information, including the onward transfer of such information, will be subject to the laws of the United States and no other country's laws.

 

4. Collection of Information for Third-Parties

We do not allow third-party companies to solicit or to advertise to our users directly, and we do not provide any user's PI to any third party for that third party's direct marketing purposes.

 

From time to time we may develop relationships, including sponsorship relationships, with third parties where we either create third party-branded themed areas within the Site or provide third party-branded virtual goods or services within the Site. Such third party-branded areas or virtual goods and services are not provided by such third parties, and we do not provide such third parties with information about individual users. We may, however, provide such third parties with aggregate information about use of such branded areas or virtual goods and services (e.g., number of users over a given period, demographic breakdowns of users (e.g., by age or gender), etc.). While we will use reasonable efforts to render anonymous any aggregated information we disclose, it is possible that the combination of information available from third parties with such anonymized, aggregated information could result in the ability to "de-anonymize" such information. We have no control over the information available from third parties, particularly information you have provided to such third parties. The first time your child visits such a third party-branded themed area or obtains third party-branded goods, we will notify you via the email address on your account. Other companies or organizations may have links to their Sites on our Site (e.g., the TRUSTe logo at the top of this Privacy Policy). We are not responsible for how these other companies or organizations collect, use, disclose, or secure the information that you provide them. If you choose to access a third party Site linked to our Site, you do so at your own risk and subject to any terms of service or privacy policy (if any) associated with such third party Sites.

 

5.Security

The security of your personal information is important to us. We have put in place physical, electronic, and managerial procedures to safeguard your personal information and help prevent unauthorized access to and maintain data security of the information we collect online. When you enter sensitive information, such as your credit card number, on our membership subscription form, we encrypt that information using secure socket layer technology (SSL). You should never share your password with anyone else and you should always logoff before leaving your computer. If you believe someone has unauthorized access to your password or account, please contact us promptly. We cannot protect against all threats, particularly threats to your computer from other sources on the internet. We encourage you to protect your computer with up-to-date anti-virus and anti-spyware products, and to practice safe computing practices when you are online. 6. Financial Information

As noted in Section 1, if you purchase a membership for your child, your full name, email address, credit card billing information including mailing address will be required at the time of purchase. That information is not stored by MyMiniPeeps, and, instead, is collected and stored by our payments processing vendor for the purpose of processing payments made to MyMiniPeeps. Our payments processing vendor complies with the Payment Card Industry Data Security Standard, and the information you provide will not be used for other purposes.

 

7. Access to Information, and Objection to Information Collection and Retention

Please contact our Privacy Director as provided in Section 8 if you would like to access the PII that we have collected online from you or your child, correct factual errors in such information, request to have this information deleted, or request that we no longer collect or maintain such information.

 

Please be sure to include your email address and a telephone number where we can reach you. To protect you and your child's privacy and security, we will take reasonable steps to help verify your identity before granting you access to the personal information that we collect and maintain about you or your child.
